FOOD SALES CONTRACT CONCLUDED ONLINE

Article 1: General conditions of sale

a) This contract is concluded between Réserve Locale 1250, Route Marie-Victorin, Lévis, Quebec, G7A 4G1, Canada; and the customer, whose contact details are those that you entered in the delivery and payment form, which appear in your order confirmation email.

c) By this distance food sales contract (hereinafter the “contract ”), the Customer purchases the foodstuffs detailed in the order summary.

d) The cost of the sale is that displayed in the order summary and is due upon conclusion of this Contract. For the purposes of this payment, you will be redirected to an external Shopify transactional platform . You will be subject to the conditions of use of this external transactional platform.

e) The Contract is formed on the date and time we send you the order summary and this contract to the email address you provided in the customer information in the payment section.

f) The charges relating to the handling and delivery of your order, if applicable, are those indicated in the Order Summary (including applicable taxes) and no other charges will be billed to you.

g) The customer acknowledges that the company is only the seller of the foodstuffs displayed on the platform and that he is in no way involved in the production or preparation thereof.

h) The customer undertakes to contact the food producer directly for any information or questions concerning its products (nutritional information, information regarding the use or preparation of food).

i) Format and description Réserve Locale Inc. ensures that the photos, descriptions and weight of its products correspond as closely as possible to what you will receive, but we cannot guarantee their total accuracy.

j) Given the perishable nature of foodstuffs and the production and delivery times of orders, the customer cannot resolve, cancel or request a refund of orders placed. By accepting the contract, the customer understands and accepts the final and definitive value of the goods ordered and waives the right to request resolution, cancellation or reimbursement, subject only to the following.

k) Each sale is final and we do not accept any returns of products since they are perishable . Only products that do not meet a normal quality standard that a customer is entitled to expect may be exchanged, subject to compliance with the Contract and, more specifically, Article 2 “Delivery of foodstuffs”. To request an exchange, the customer must keep the item in the condition in which it was delivered, take a photo of the product, communicate without delay with the company so that it can decide on the eligibility of the product for an exchange and make arrangements with it for the delivery of an equivalent product, if applicable.

l) In certain situations, only a refund is granted and with the agreement of the Réserve Locale Inc. sales team: (if applicable)

* Products damaged during delivery (photo required)

* Products expired upon receipt of order (photo required)

* Products deemed to be in poor condition by the sales team (photo required)

Once we receive and inspect the product photo, we will send you an email to confirm that we have received it. We will also notify you of our decision whether to approve or reject your refund request. If your request is approved, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain number of days.

m) The Company reserves the right to refuse to exchange any product if it has reasonable grounds to believe that the customer is responsible for the facts supporting the exchange request.

n) It is necessary to contact our customer service within 72 hours of receipt of the order with an error. By phone at 418-317-9400 or by email at info@reservelocale.ca

o) We reserve the right to choose the method of reimbursement, either by credit card or by gift card, depending on the error made.

Article 2. Delivery of foodstuffs

a) The Delivery Person makes the delivery to the location specified by the customer in the order summary during the time slot he has chosen from the periods offered by the company. The customer undertakes to be present at the place of delivery for the entire duration of the period chosen for initial delivery in order to take possession of the order, otherwise the delivery person will leave the box in front of the door of the customer's residence , or at the location indicated by the customer in the “note to delivery person” section on the transaction web page.

c) It is the customer's sole responsibility to ensure that the food is refrigerated or consumed upon receipt of the order. If the food is not refrigerated or consumed upon receipt of the order box, the food may be unfit for consumption and the customer should not consume it. No form of compensation or financial compensation will be granted to the customer in this regard. Réserve Locale Inc does not provide any guidelines as to the reasonable time elapsed between delivery and opening of the box (weather differences cause the effectiveness of insulated packaging to vary significantly).

d) The Customer understands and accepts that in his absence and if the condition of the premises allows it according to the reasonable judgment of the delivery person, the delivery person may leave the order at the place of delivery (e.g. in front of the door of the residence). The customer releases the company, entirely and without reservation, from any liability in connection with such delivery of the order, particularly in the event of theft, vandalism or bad weather.

e) If the delivery person is unable, for whatever reason, to leave the order at the delivery location in the absence of the customer during the initial delivery, the delivery person will retain the order and return it to the business. The delivery person may not at any time leave the order at the place of delivery when it is located, in particular, in a multi-unit complex, in a group of residences held in divided co-ownership (condominiums) having a common entrance or in any other location having similar characteristics. The customer must then contact the company to schedule a second delivery, for which transportation and handling costs must be paid by the customer to plan the resumption of delivery ($20). An invoice will then be sent to the customer by email, payable online. However, if it is not possible to establish a new delivery within appropriate time limits for the conservation of foodstuffs and to ensure their quality, or if the Customer fails to make himself available for the new delivery, the company will be able to dispose of these products and no refund will be offered to the customer for undelivered goods.
